Collaborative Law
Collaborative Law is a process of resolving family law conflicts in a cooperative approach without litigation. In this process, the parties and their attorneys sign a Participation Agreement. The Participation Agreement requires the parties to exchange financial information to enable each spouse to make well-informed financial decisions; maintain confidentiality, so that each spouse feels free to express his/her needs and/or concerns; reach written agreement on all issues and concerns outside of contested court proceedings; and authorize their attorneys to use a written agreement to obtain a final court decree. This model seeks to keep the parties and their attorneys committed to a collaborative process by requiring the parties' respective attorneys to withdraw from representation if either party decides to litigate. Collaborative law may be appropriate for those clients who believe that it is important to protect their children from the harm litigation can cause; place a high value on personal responsibility in resolving conflict; focus on a positive solution for their entire family; preserve a working relationship with the other spouse after divorce; and believe that no settlement can be fair and equitable unless full disclosure occurs regarding financial issues.
